“的”字句是指，由“的”构成、以“的”字结构为标志的句子。“的”字结构事实上省略了作为逻辑主语的行为者，在法律文书中尤为常见。“的”字结构的多种形式中，用于法律文书的主要有“动宾词组+的”，如：“构成犯罪的”，“获得证书的”等等。

汉语法律语言中“的”字结构的频繁使用是为了达到语言庄重、简洁、严谨的效果，同时体现了法律语言的程式化特点。如：对于扣押的物品、文件、邮件、电报或者冻结的存款、汇款，经查明确实与案件无关的，应当在三日以内解除扣押、冻结，退还原主或者原邮电机关。（《中华人民共和国刑事诉讼法》第118条）

另外，汉语法律语言中“的”字结构常用来做主语，表示假定的条件，通常前置。如：“以营利为目的，制作、贩卖淫书、淫画的，处三年以下有期徒刑、拘役或者管制，可以并处罚金。”可见，由“的”字结构构成的主语形式具有很强的概括性，可以成为一个具有代表性的概念，从而符合法律语言的需要。

例1：阴谋颠覆政府、分裂国家的，处无期徒刑或者十年以上有期徒刑。

最后，法律英语中的条件通常用if，where，when句子或短语表示，位置不固定。因此，当汉译英时，“的”字结构可翻译为if句式或where 句式。

例2：监护人不履行监护职责或者侵害被监护人的合法权益的，应当承担责任；给被监护人造成财产损失的，应当赔偿损失。人民法院可以根据有关人员或者有关单位的申请，撤销监护人的资格。

参考译文：If a guardian does not fulfill his duties as guardian or infringes upon the legitimate rights and interests of his ward, he shall be held responsibility; if a guardian causes any property loss for his ward,he shall compensate for such loss. 例3：企业之间或者企业、事业单位之间联营，组成新的经济实体，独立承担民事责任、具备法人条件的，经主管机关核准登记，取得法人资格。

需注意的是，有时在立法表述时，在一个法律条文中往往连用或并列使用几个“的”字结构。
