第六条　使馆和使馆人员进出境公用、自用物品，应当按照海关规定以书面或者口头方式申报。其中以书面方式申报的，还应当向海关报送电子数据。

　　第七条　外交代表携运进出境自用物品，海关予以免验放行。海关有重大理由推定其中装有本办法规定免税范围以外的物品、中国政府禁止进出境或者检疫法规规定管制的物品的，有权查验。海关查验时，外交代表或者其授权人员应当在场。

Article 6 The incoming or outbound articles of a diplomatic mission or its staff for official or personal use shall be declared in writing or orally in accordance with the provisions of customs. For a declaration in writing, electronic data thereof shall also be submitted to customs.

Article 7 Where a diplomatic officer carries with him/her articles for personal use into or out of China, the articles shall be directly released by customs without inspection. If customs has substantial ground to believe that the articles contain items not included in the duty-free scope as prescribed in these Measures, or items whose entry or exit is prohibited by the Chinese government or subject to control by quarantine regulations, customs has the power to inspect the articles. The diplomatic officer or the person authorized thereby shall be present at the inspection conducted by customs.

　　第八条　有下列情形之一的，使馆和使馆人员的有关物品不准进出境：

　　（一）携运进境的物品超出海关核准的直接需用数量范围的；

　　（二）未依照本办法第五条、第六条的规定向海关办理有关备案、申报手续的；

　　（三）未经海关批准，擅自将已免税进境的物品进行转让、出售等处置后，再次申请进境同类物品的；

　　（四）携运中国政府禁止或者限制进出境物品进出境，应当提交有关许可证件而不能提供的；

　　（五）违反海关关于使馆和使馆人员进出境物品管理规定的其他情形。

　　使馆和使馆人员应当在海关禁止进出境之日起3个月内向海关办理相关物品的退运手续。逾期未退运的，由海关依照《海关法》第三十条规定处理。

Article 8 Under any of the following circumstances, the relevant articles of a diplomatic mission or of its staff shall be denied entry or exit:

(a) The articles to be carried into China exceed the directly needed quantity as ratified by customs;

(b) Formalities of recordation and declaration fail to be gone through at customs in accordance with Articles 5 and 6 of these Measures;

(c) In the absence of approval by customs, articles imported duty-free are transferred, sold or disposed of otherwise, and application for import of the same type of goods is filed again;

(d) The entry/exit of articles to be carried into/out of China is prohibited or restricted by the Chinese government, and relevant license documents fail to be presented; or

(e) Other circumstances where there is violation of the administrative provisions of customs on the entry/exit of articles of diplomatic missions and the staff thereof.

If the entry/exit of articles of a diplomatic mission or a member of its staff is denied by customs, it (he/she) shall, within 3 months as of the date of denial, go through the return formalities for the articles at Customs. If it (he/she) fails to do so within the time limit, customs shall dispose of the articles in accordance with Article 30 of the Customs Law.

　　第九条　使馆和使馆人员免税运进的公用、自用物品，未经主管海关批准，不得进行转让、出售等处置。经批准进行转让、出售等处置的物品，应当按照规定向海关办理纳税或者免税手续。

　　使馆和使馆人员转让、出售按照本办法第十条、第十一条规定免税进境的机动车辆以及接受转让的机动车辆的，按照本办法第五章有关规定办理。

Article 9 Without the approval of the competent customs house, no diplomatic mission and none of its staff members shall transfer, sell or dispose otherwise of any of its/their articles imported duty-free for official or personal use. When transferring, selling or disposing otherwise of the articles after approval has been obtained, it/they shall go through the formalities for duty payment or duty exemption at customs.

Where a diplomatic mission or a member of its staff transfers or sells a motor vehicle imported duty-free under Articles 10 and 11 of these Measures or accepts the transfer of such a motor vehicle, it (he/she) shall follow the relevant provisions of Chapter V of these Measures.
