第三条　使馆和使馆人员进出境公用、自用物品应当以海关核准的直接需用数量为限。

　　第四条　使馆和使馆人员因特殊需要携运中国政府禁止或者限制进出境物品进出境的，应当事先得到中国政府有关主管部门的批准，并按照有关规定办理。

　　第五条　使馆和使馆人员首次进出境公用、自用物品前，应当持下列资料到主管海关办理备案手续：

Article 3 The articles imported and exported by diplomatic missions and the staff thereof for official or personal use shall be limited to the directly needed quantity as ratified by Customs.

Article 4 Where, out of special needs, it is necessary for a diplomatic mission or a member of its staff to carry into or out of China an article whose entry or exit is prohibited or restricted by the Chinese government, it (he/she) shall acquire the approval of the competent authorities of the Chinese government in advance and comply with the relevant provisions.

Article 5 Where a diplomatic mission or a member of its staff is importing or exporting an article for official or personal use for the first time, it (he/she) shall go to the competent customs house and present the following documents for recordation formalities in advance:

　　（一）中国政府主管部门出具的证明使馆设立的文件原件及其复印件；

　　（二）用于报关文件的使馆馆印印模、馆长或者馆长授权的外交代表的签字样本一式五份；

　　（三）外交邮袋的加封封志实物和外交信使证明书样本一式五份。

　　使馆如从主管海关关区以外发送或者接收外交邮袋，还应当向主管海关提出申请，并提供外交邮袋的加封封志实物和外交信使证明书样本，由主管海关制作关封，交由使馆人员向进出境地海关备案。 

(a) The original document issued by the competent authorities of the Chinese government that certifies the establishment of the diplomatic mission, and a photocopy thereof;

(b) A sample of the seal of the diplomatic mission and a sample signature of the head of mission or of the diplomatic representative authorized thereby, which are to be used for customs declaration documents, in quintuplicate; and

(c) A physical seal for diplomatic pouches and a sample certificate for diplomatic couriers, in quintuplicate.

If the diplomatic mission intends to send/receive a diplomatic pouch to/from an area outside the jurisdiction of the competent customs house, it shall file an application with the competent customs house and present a physical seal for diplomatic pouches and a sample certificate for diplomatic couriers. The competent customs house shall make a customs seal and hand it to the staff of the diplomatic mission, who shall then go through the recordation formalities at the customs house of the point of entry/exit.

　　（四）使馆人员和与其共同生活的配偶及未成年子女的进出境有效证件、中国政府主管部门核发的身份证件原件及其复印件，以及使馆出具的证明上述人员职衔、到任时间、住址等情况的文件原件及其复印件。

　　以上备案内容如有变更，使馆或者使馆人员应当自变更之日起10个工作日内向海关办理备案变更手续。

(d) The valid entry/exit certificate of the staff member of the diplomatic mission and his/her spouse and underage children living together with him/her, the original identity certificate issued by the competent authorities of the Chinese government and the photocopy thereof, and the original document issued by the diplomatic mission for certifying the title of the aforesaid member of the mission, time of arrival, residence address, etc. and the photocopy thereof.

If there is any change to the above recordation information, the diplomatic mission or the member of its staff shall, within 10 working days as of the date of change, go through the formalities for modifying the recordation at the customs house.
