中标者在收到中标函后于两周内自费取得履约保证，办理有信誉银行的履约保证。其金额为合同价格的XX%，保证按时履行本合同。
The successful tender shall, within two weeks of the issue of a Letter of Acceptance ，at his own expense obtain in the form of a performance Bond，the guarantee of a reputed bank in a sum equivalent to XX percent of the contract price for the due performance of the contract.
由于合同中双方当事人的权利与义务是对等的，一方的权利是另一方的义务， 同时，一方的义务又是另一方的权利。因此，合同各方为确保自己权利的实现，都可以要求另一方设立履约担保（银行保函）。在银行的保函中，应明确合同规定的各 项义务和时间以及担保银行的保证条件等。下面是一例银行
