以上单词均有将某人驱逐出不动产之外的含义。ejectment 为“驱逐非法占有人之诉”，主要指普通法所规定的一诉讼，原告目的是驱逐土地或建筑物的不法占有人且主张得到损害赔偿金，即将不法占有人驱逐而恢复自己的合法权益。现在，ejectment 已经逐渐演变成纯粹的就不动产产权进行争议的诉讼[1]。ouster则刚好相反，多指非法将某人从其合法占有的不动产中驱逐出去而达到非法占有的目的，故其为“非法驱逐他人而强占 财产”，其为一过错行为（wrong) [2]。eviction多指对房客或佃户的驱逐，其可为合法驱逐，特别是依法向法院提起诉讼；也可指非法驱逐，如非法入侵者驱逐合法所有人或房东或地主违法将租户或佃户驱逐[3]。
