两术语经常被人混淆。尽管access本身有“进入、通过”等含义(to enter，approach，pass to and from a place，a landowner's legal right to pass from her or his land to a highway and to return without being obstructed[1] )，但 access right 却是家庭法上的术语，指离婚父（母）对不属于他（她）监护的子女的“探视权”或“探望权”（A right, granted in an order or agreement, of access to or visitation of a child. Family Orders and Agreements Enforcement Assistance Act, R. S. C.，1985，c. 4, s. 2 [2]），而非有些词典中所说的“出入权”或“通行权”。真正的“通行权” 正是right of way，其属于地役权（easement)的一种，及在他人拥有的土地上通行经过的权利（A person's legal right，established by usage or by contract，to pass through grounds or property owned by another。[3])。
