第一，我国的民事起诉状中，送达法院名称应放在起诉书的末尾，翻译成英文的时候应将送达法院放置到最前面，这样做比较符合英美律师和法律工作者的行文习惯，便于他们阅读。我国的民事起诉书翻译成英文时并没有完全改头换面，虽然对送达法院的位置做了调整，但是其他部分都尽可能地遵循中文起诉书的格式要求。如第一部分介绍原被告的身份事项，第二部分原告则向中华人民共和国相关法院提出了具体的诉讼请求，第三部分对事实和理由进行陈述，最后提交与诉讼有关的材料，这些都是符合中文起诉书的规范，与英美的民事起诉书的要求是不一样的。此外，中文涉外起诉书中有一些经常用到的句子，如：
①“原告认为，原被告之间的纠纷应适用中国法律”可译为It is the Plaintiff's position that the dispute arising between the Plaintiff and the Defendant shall be subject to Chinese laws.
②“被告的某些行为或被告未尽到应尽的义务给原告带来了巨大的经济损失”可译为 The Defendant's deed to .…. or The Defendant's failure to ... resulted in tremendous economic losses accruing to the Plaintiff.
③“按照中国的相关法律法规，被告必须承担因……所致的民事责任”可译为 Pursuant to the relevant PRC laws and regulations, the Defendant shall assume civil liability accordingly for ...
④“基于以上理由，依据《中华人民共和国民法通则》第……条，和《中华人民共和国民事诉讼法》第……条及其他相关可适用法律法规，原告特此向贵法院提起诉讼，请予以公断”可译为By reason of the foregoing,in accordance with Article...as set forth in the General Principles of the Givil Law of the PRC, Article... as set forth in the PRC Civil Procedural Law and other applicable laws and regulations, the Plaintiff hereby files this case with the Court for its fair adjudication.
第二，将英文的民事起诉书翻译成中文时几乎可以完全保留原文的格式和具体要求。英文的起诉书在正文的很多部分也会经常用到一些惯用语和套句，译者应熟悉并好好运用这些惯用语和套句，例如：
① Now comes the Plaintiff,.…., by and through his or her attorney, …., and by way of his or her complaint，states as follows：..兹有原告xx经由他的/她的律师×x代理，就其起诉状，作如下陈述：……
② Comes now, Plaintiff above named and hereby complains of Defendant and by way of cause of action alleges：上述原告向法庭呈递诉状起诉被告，提出如下诉讼理由：……
③ This is an action for damages based on...in violation of...这是一起因违反……基于某种行为所引起的损害赔偿诉讼。
④Jurisdiction of this court is based upon...本法院的管辖权是依据……
⑤Jurisdiction over state law claims herein is based on...本案对于州法律上的请求的管辖权乃是依据……
⑥ Venue lies in this District pursuant to...依据……审判地处在本地区。
⑦ Therefore,Plaintiff prays for the relief he or she is entitled to pursuant to...and the regulations propounded pursuant thereto,including...因此原告请求根据……及相关规则有权获得的救济，包括……
⑧ Wherefore, Plaintiff prays for judgments as follows: ... or Wherefore, Plaintiff respectfully requests that this court grant the following relief:.….为此,原告请求法院作出如下判决：……
