两者均是与动产被他人非法占有相关的普通法上的诉讼。区别在于detinue ( “因财产被非法占用而索赔之诉”）是指因财产被被告非法扣留而要求索回原财产之诉（a common law action for the recovery of person property belonging to the plaintiff that is wrongfully detained by the defendant[1])。而 trover ( “追索非法占用财产之诉”) 则指因财产被非法占用而要求得到原财产价值数量之补偿，而非原物本身[2]，其也称为trover and conversion。
