以上单词或词组均有强制性命令的含义。其区别在于injunction 为 “强制令”，指法庭作出的强迫一方当事人实施或不予实施某特定行为的命令。其包括“禁止”和“强迫实施”双重含义[1]，故不宜像有些词典那样将其译为窄义的“禁令”或 “禁制令”[2]，而应为广义的“强制令”。其是衡平法上的一种救济，主要是预防未来的伤害行为的发生而非对已经发生的损害进行补偿，违反强制令者将以藐视法庭（be subject to penalty of contempt)论处。cease and desist order指的是由法院或准司法裁判庭所作出的制止继续进行某个具体的活动或行为之命令， 故应译为“制止令”[3]。mandamus (也称为writ of mandamus) 则与cease and desist order正好相反，它是指主管法院对下级法庭、官员、行政机构、法人、个人发出的迫使其履行法定责任范围内的职责的特别令状（extraordinary writ)，故应译为“执行令”[4]，其主要针对行政行为的履行而言，而非其他法院根据其 自由裁量权而对被告施加的其他行为。
