乍看上去,上述单词或词组似乎均有“受害人”的含义, 但究其内涵差异却极大。首先是aggrieved party,因单词aggrieve 在表示“伤害”或“不公正对待”时,只适用于法律场合情况下的伤害[1],故在法律英语中,aggrieved party (也称为party aggrieved 或person aggrieved)专指在司法或准司法程序中其合法权益受到伤害或不公正对待者,即受到认为不公正的判决、命令或惩处者。按规定,此种人具有上诉或申诉之权利地位(standing as an appellant or a petitioner or a complaint) [2]。为与其他“受害人”相区别,最好将其译为“受屈人”[3]或“权益受侵害人”或不服判决、命令等的“上诉人”或“申诉人” [4]。 因此,the aggrieved party in a case便应为“案件受屈人”,指在案件中的受到不公正待遇者,或“案件申(上)诉人”,指案件中的plaintiff或petitioner,而不应是有些词典中的“案件中受害的一方”或“被害人”[5]。injured person和victim则是指其权利、财产或人身等受到其他当事人伤害者,injured party指法律诉讼中的曾受到另一方当事人行为伤害的“受害人”,即原告[6]。victim尤指犯罪、侵权或其他过错行为之受害人[7]。
