两者均与信托有关。在信托中，财产，尤其是不动产的权益一般分为普通法上的权益和衡平法上的权益[1]。trustee ( “受 托人”）属普通法上的财产权益所有人，其持有法律名义上的财产所有权[2]。而beneficiary (信托受益人）则被视为是获得信托真正好处的衡平法上的权益所有人，其应享有财产的收益权、用益权等实际权利[3]。
