两者之间的差别在于adjudicative fact (争议事实,诉争事实)是指诉讼,尤其是行政裁决程序中与当事人具体相关的事实,如个人动机、故意等,其为个案属性[1]。
而legislative fact (立法事实)则泛指与案件具体当事人的个人问题无关,即不属于个案性质而属于法律规定的具有一般属性的社会、经济、科 技等的事实问题,
其只在帮助法定或行政机关决定该立法的内容及适用范畴[2]。
