两个单词均有“监护人”的含义。其区别在于tutor多在大陆法中指未成年人的监护人[1]。而curator可用在普通法中，指很久之前对已经达到full age和具有一切权利之人（尤指males, 称为a person who is sui juris)的临时监护人[2]；在大陆法中，curator则同样可指对未成年人，即minor有监护权的监护人，只是其监护的对象已经到达一定年龄段，其所负的责任与tutor也有一定差异此外，其还指法院指定的对外出而不在住所或居所者(absentee)的财产之监管人[4]。
