两者均是指英、美等国家法学院所使用的法学教科书。casebook为“案例选编”或“判例教科书”,指一种包含法院主要判例及其评论和说明,以供学生学习讨论的教科书,收集的多为上诉法院判例,且有作者注释[1]。而hornbook则为“法学基础”或“法学基础理论教科书”,主要包含某领域法律的基本原则或学说
(rudimentary principles or doctrines of an area of law)[2]。同理,casebook
method 和 hornbook method 的区别也在于前者为“判例教学法”,也称为case method、case system以及
Langdell method,主要在英美法系国家流行;而后者则是以法学原理和学说为主的“法学基础理论教学法”,也称为lecture
method,主要在大陆法系国家使用,且主要集中于诸如程序法或证据法等法律领域之教学。
