两术语经常被人混淆。尽管access本身有“进入、通过”等含义(to enter,approach,pass to and from a place,a landowner's legal right to pass from her or his land to a highway and to return without being obstructed[1] ),但 access right 却是家庭法上的术语,指离婚父(母)对不属于他(她)监护的子女的“探视权”或“探望权”(A right, granted in an order or agreement, of access to or visitation of a child. Family Orders and Agreements Enforcement Assistance Act, R. S. C.,1985,c. 4, s. 2 [2]),而非有些词典中所说的“出入权”或“通行权”。真正的“通行权” 正是right of way,其属于地役权(easement)的一种,及在他人拥有的土地上通行经过的权利(A person's legal right,established by usage or by contract,to pass through grounds or property owned by another。[3])。
