Conveyance 和 Negotiation法律术语分析及英语解释

以上单词均有“转让”的含义。transfer为通用术语,可泛指用一切方式(甚至包括遗赠)转让各种物品,包括财产及其所有的权益、票据或单据等[1]。assignment多为民法或合同法上的债权“让与”,且常指转让无形财产的权利,如:assignment of a contract, assignment of account, assignment of dower, assignment of income, assignment of lease, assignment of wages 等[2]。conveyance多指不动产,如土地物权(title)等的转让,其也包括土地其他权利的转让或租赁(lease)、按揭(mortgage)或抵押(encumbrance),但不包括遗赠[3]; 与该单词相关的词conveyancer也由此指专门从事不动产转让业务之律师(参见lawyer)。negotiation常指票据法上的权利转让,既票据之“流通”,最大特点是受让人可不受前手产权瑕疵的影响[4]。

The word is one of general meaning and may include the act of giving property by will . . .
