该单词主要指的是大陆法系而非英美法系民法上的一种物权(Servitude is primarily a civil-law term，deriving from Latin servitus.[1])，其定义为：an encumbrance consisting in a right to the limited use of a piece of land without the possession of it；或 a charge or burden of an estate for another's benefit [2]，即我们所说的“他物权”或“限制物权”（其也称为“用益物权”：usufruct), 其对物的非所有人来说是一种有限的支配权，对物的所有人来说对其所有权的行使也是一种限制。注意的是servitude虽然等同普通法系的 easement ( Servitude is equivalent to the term easement in common law.)，但并完全是easement，故不宜将其翻译为“地役权”。普通法中，servitude—般分为三类,即：easement (地役权），license (特许权）和profit (收益权）（The three types of servitudes are easements, licenses, and profits. [3])。

easement是指承役地（dominant estate)所有人使用供役地（servient estate) 所有人土地的权利，如在供役地所有人土地上的通行权或在供役地上修建道路、通讯线路等设施的多种权利，其属于一种财产权利（an easement is a property right[4])。license 是指一种可撤销的允诺(License is a revocable permission to commit some act that would otherwise be unlawful [5])，如让被特许人进入特许人的土地从事原本属于非法的活动，如打猎等，“特许”的范畴尚未达到lease或profit的程度。与easement相比，license 多为口头允诺创立，而easement为书面；license期限较短，而 easement的期限较长；easement 的所有权可随承役地所有权的变更而变更，而license则纯粹是人身属性的权利，不得被转让或出售。profit则是指在他人所有的土地上放牧、采矿、伐木等取走某些有价值的产物的权利(a servitude that gives the right to pasture cattle，dig for minerals，or otherwise take away some part of the soil [6])，其也称为 profit a predre 或 right of common。
