两者均有三人或三人以上非法集会以滋事的含义。它们的区别在于rout源于route，指非法集会者“on their way”，故其不一定实际实施了其旨在的犯罪，且其行进的方式也并非是 “tumultuous manner"[1]，因而不宜像有些词典那样将其视为riot而译为“聚众闹事罪”或“骚扰罪”[2]，实际上该单词应为“聚众前往闹事罪”。riot则指三人或多人非法集会以暴力威胁或恐吓公众之方式破坏治安，故为“聚众骚乱罪”或“暴乱罪”，按普通法规定其为“轻罪”（misdemeanor) [3]。根据1714年通过的制定法，即Riot Act，凡12人以上不法集会扰乱治安，警告后仍聚集一小时以上者则可视为是重罪“felony”，可处以终身监禁（在刚通过该法时，其是capital offense)[4]。
