前言的格式相对固定，尤其是首尾两部分，文字基本上可以照搬。上面译文除“鉴于”之后省去未译的内容外，其余都可以照搬到其他合同及其翻译之中，但是“鉴于条款”的内容则因合同性质不同而不同，这是至关重要的，在起草和翻译时一定要注意其准确性。前言的结尾部分也可简化为：NOW，therefore, the parties hereto agree as follows ；
本文最引人注目的是定义条款。对合同中频繁出现且含义复杂的用语做出定义，有助于合同文字的简洁、准确。经常在合同中做出定义的用语有product (产品），exclusive territory (独占地区),licensed product (许可产品), trademark (商标），know-how (专有技术），industrial property right (工业产权）， technical documentation(技术资料）等。定义往往对双方的权利和义务有很大关系，不可掉以轻心。当然合同中可以不立“定义”这一条，而采用其他定义方式。如下例定义：
“Patents”mean the patents and patent applications now owned by the Licenser in the territory pertaining to the licensed products, as listed in the Exhibit A of this Contract.

合同结尾可以在最后一条之后直接由双方签字，也可以在签字处之前加上诸如下列一'段文字：In witness whereof the parties hereto have caused this Agreement executed in duplicate by their duly authorized representatives oil the date first above written.(本协议已分别由双方正式授权代表在上文首次提及的日期签字，一式两份，以资证明。）
