（11）关于业主、买方、卖方、用户几个词

招投标文件，合同文件中常用到 Owner，Seller, Buyer，Contractor，Client，Customer，Subvendor等词。按照IS09000标准，业主一词在合同文件中取消，不再使用， 据外国专家解释说，业主一词指代不清楚，与Contractor—样，它可以指买方，也可以指卖方，因为卖方作为一个提供设备、设计和服务的实体，本身就可以是一个业主，因此业主一词用在合同文件中就比较模糊了。最清楚的方法就是用买方（buyer)和卖方(seller)这样一对相互对立的词。customer和client尽管也有买方的意思，但在英语中使 用的范围很有限。customer 指的是 person gets things for his money，as in a shop。而 client is a person who gets services，as from a lawyer，a bank，or a hairdresser。因此我们认为在大型设备的招投标文件中用这两个词是不妥的。subvendor是分包商的意思，在合同文件中经常用到。

值得注意的是，招投标文件和合同文件中通常只有一个买方。但是我国管理机制与国际上不同，在对外贸易中有一个窗口，我们便称之为买方（Buyer)，而直接用户（end- user)则称之为业主（owner)。为了避免混乱，我们在招投标文件中及合同文件中首先给出definition，例如这几个词在河津电厂工程中是这样定义的：
