招标文件中的条款很多，对每一条款，作为投标商都应仔细核对，消除模糊。例如前几年我国某公司在承担某国外工程时，条款中规定我方在现场的工作人员应有舒适的宿舍，有卫生设施。由于我们经验不足，没有对这一条款做出详细澄清，到了现场以后才发现，宿舍是临时修建的工棚，并且四个人一间。卫生设备也极其简陋，还不配置空调，所在国气温又特别高，生活条件相当艰苦。而国外一家公司在投标我国的一个工程时，关于 现场人员的居住条件是这样写的：

For personnel without family：

One (1) a bedroom properly furnished and cleaned，complete with private bathroom equipped with all facilities；

For personnel with family：

One (1) an apartment, properly furnished and cleaned and complete with kitchen and bathroom all equipped with necessary facilities. The Contractor shall inform the Owner of personnel with family one month in advance of their departure.

The Buyer shall make available to the Seller’s technical personnel office space，working clothes and necessary working tools free of charge and shall arrange for the boarding of the Seller’s technical personnel and their families with western and Chinese cuisine but the relevant cost shall be borne by the Seller.

在这段文字中，既有清楚的一面，也有模糊的一面。但从模糊的这一方面来讲，又是对国外人员有利的，比如 with all facilities 以及 equipped with necessary facilities 就是一个比较含糊的概念。如果我们所配给的设施没有达到他们的要求，他们便可据此争取。

当然国内公司也曾成功地利用模糊语言争取了一项国外工程。招标文件中关于供水系统是这样写的：

Complete water supply system including 10X300m3/h deep well pumps to be installed at

canal bank pipeline of adequate size including all valves, supports and installations，setting tanks as specified in clause 3. 6. 4. 9 这个工程的水源地在距电厂5公里之外的运河，从文字上讲上述的供货范围是属于投标商的供货范围，招标文件中的附图却把这水源地放到业 主的供货范围。我方就是利用了招标文件中文字与附图之间的矛盾，做出了全部响应标书 的投标文件，在澄清会上我方故意回避这个问题。如果当时把这个问题谈清楚，报价上我方就会吃大亏，也拿不到标。当然最后的结果肯定是对我方有利。

从以上分析可以看出，模糊语言出现在招投标文件中的现象，一是人为造成；二是受语言、文字限制。但是从各自的利益来讲，招标方需要弄清楚的，也正好是投标方需要模糊的，反之亦然。应该把握住时机，对一些模糊语言进行澄清，招标方的最佳澄清时间是 评标阶段，投标方的最佳澄清时间是标前会。
