上例中的模糊语言在招标文件中能够存在的另外一个原因是，投标方可以根据自己某 一系统设计原则提出超出招标方所要求的供货范围，同时在投标报价中也考虑了 not be limited to the following and without excluding other necessary components and services not mentioned。 从这个意义上来讲，这一条款对招标方和投标方又是平等的。

在评标阶段，作为保护性条款，招标方往往会发出这样一份电传要求投标方予以确认：

Except the deviations you submitted in the bids, all the requirement specified in the Bidding Documents shall be satisfied.

投标方收到这样的电传后往往不能给予及时答复，这里边就可能有“埋伏”。

例如在一份招标书中有这样的要求：For outdoor equipment or vessels without hoisting frame，a mobile jib crane of appropriate capacity shall be provided. 有一家投标商对这一条款既不提出偏差，在供货范围里又不提供a mobile jib crane。这时招标方就要直截了当地对这台mobile jib crane的供货进行澄清。经过澄清，投标方果然找了许多不提供这台汽车吊的理由，而招标方就针锋相对，坚持要投标方提供。

作为投标方，在投标过程中有时也做一些假象，本来很清楚的东西，他却从另外一个角度提出要求。有一家的投标书是这样写的：

We will supply equipment and design work as per the current standards and codes. If the stringent or higher standards and codes are adopted when executing the contract, the bid price would be adjusted.

咋一看这一要求是合理的，其实It's run allowed。因为一般的招标文件都规定了标准和规程，如果要用替代标准，则这个标准应该是相等的或更严格的，那么adjusting price 就是不允许的。

有时招标文件中还有这样的规定：All other instruments and special meters needed in the field test shall be supplied together with calibration data by the Contractor. 但是却没有规定这些现场所用试验仪器是return to the bidder还是left to the buyer，这些对执行合同都带来不少的困难。

对招投标文件中的一些模糊词组一定要弄清楚，如有一家投标商承诺提供一台备用的控制柜（spare cabinet),可是到货以后才发现仅是一台空的铁皮柜，里边的线路和元件还得另外出钱购买，这就是投标商钻了定义不明确的空子。因此对招标商来说在编写招标文件时对 spare cabinet 就得明确定义为 shall be complete with apparatus and be ready to use。
