两者均与时效有关。尽管statute of limitation (诉讼时效法） 有时也可被称为“statute of repose”（时效休眠法）[1]，但statute of limitation是与所涉及的诉讼时效与伤害（after injury occurs) 有关，按其规定，在伤害发生后一特定期间内如不起诉则会丧失诉权[2]。而statute of repose则与伤害无关，按其规定，不论是否有伤害发生（regardless of whether there has yet been an injury),只要超过某一特定时间，任何诉权便将终止[3]。
